Delhi Commission for Protection of Child Rights

(Constituted under the Provisions of the Commissions for Protection of Child Rights Act, 2005 and Notification dated 08.09.2008, NCT of Delhi)

1. The Delhi Commission for Protection of Child Rights (DCPCR) has been constituted under the provisions of The Commission for Protection of Child Rights Act, 2005, to serve to the best interest of children of Delhi, below eighteen year of age. The Commission is empowered to examine and review the safeguards under any law for the protection of child rights and recommend measures for their effective implementation; present annual and special reports to the government; enquire into violation of child rights and recommend initiation of proceedings in such cases; examine factors at that inhibit rights of children affected by terrorism, violence, disaster, HIV/AIDS, trafficking, mal-treatment, exploitation, pornography and prostitution.
2. The Commission is also empowered to recommend remedial measures; look into matters related to children in need of special care and protection including children in distressed, marginalized and disadvantaged children, children in conflict with law, juveniles children without family and children of prisoners for appropriate remedial measures. This Commission can also periodically review treaties, international instruments, government policies, programmes and activities on child rights and to make recommendations for their effective implementation in the best interest of children.
3. The Commission can also promote research, literacy and awareness with respect to child rights and to safeguards the same through media, publication, seminar etc., The Commission can inspect any juvenile custodial home and residential institutions run by the govt. and/or social organizations to ensure proper care, treatment, reformation and rehabilitation of children and also to take up the matter with concerned authorities for remedial action if found necessary. It is also the objective of the Commission to promote respect and also to develop a culture of giving serious consideration to children's view in the activities of the govt. and organizations, besides promotion and incorporation of child rights in various fields of activities.
4. The Commission is empowered to undertake inquiry into complaints and to take suo-moto notice of matters relating to
   1. Deprivation and violation of Child Rights
   2. Deprivation and violation of Child Rights Non-implementation of laws providing or protection and development of children
   3. Non-compliance of policy decisions, guidelines or instructions aimed at mitigating hardships and ensuing welfare of the children and to provide relief to such children.
5. The Commission, while inquiring into any matter have all the powers of a civil court trying a suit under the code of civil procedure 1908 and in particular, in respect of the following matters
   1. Summoning and enforcing the attendance of any person and examine him on oath,
   2. Discovery and production of any document,
   3. Receiving evidence on affidavits,
   4. Requisitioning any public record or copy thereof from any court or office, and
   5. Issuing commission for the examination of witnesses or documents.
6. The Commission also has the powers to forward any case to a Magistrate having jurisdiction to try the same.The Magistrate to whom any such case is forwarded shall proceed to hear the complaint against the accused as if the case has been forwarded to him u/s 346 Cr.P.C., 1973.
7. The Commission is statutorily empowered to take any of the following steps after completion of the enquiry,
   1. Where the enquiry discloses, the Commission of violation of child rights of a serious nature or contravention of provisions of any law for the time being in force, it may recommend to the concerned Government or authority the initiation of proceedings for prosecution or such other action as the Commission may deem fit against the concerned person or persons,
   2. Approach the Supreme Court or the High Court concerned for such directions, orders or writs as that Court may deem necessary, and
   3. Recommend to the concerned Government or authority for the grant of such interim relief to the victim or the members of his family as the Commission may consider necessary.
